1. Acceptance of Terms

By accessing and using waminingindex.com.au ("the Platform"), operated by WA Mining Index (ABN: 15 374 944 529), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use the Platform.

By using the Platform, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into a binding agreement, on behalf of yourself or the corporate entity you represent.

2. Nature of the Platform

WA Mining Index is an online directory and information resource focused on the Western Australian mining sector and adjacent service industries, including drilling, logistics, safety equipment, labour hire, maintenance, geotechnical services, equipment supply, and related providers.

The Platform aggregates publicly available information from state government databases (including MINEDEX, the Western Australian government's official database of mines and mineral deposits), corporate registries, business websites, and other public sources, and presents this information within a curated taxonomy.

The Platform may list service providers and contractors operating in the Western Australian mining sector, including business information such as company name, region of operation, services offered, and publicly available business contact channels.

Unless a listing is explicitly identified as a paid placement (such as a "Verified Listing"), inclusion in the Platform does not imply any commercial relationship, endorsement, sponsorship, or affiliation between WA Mining Index and the listed party.

3. Information Accuracy

While we make reasonable efforts to maintain accurate and current information, raw data in the mining sector is highly volatile. We do not guarantee the absolute correctness, timeliness, or completeness of any information published on the Platform.

Users must conduct their own due diligence before signing contracts, deploying machinery to referenced coordinates, or entering into commercial relationships with any party listed on the Platform.

Government data sourced from MINEDEX and equivalent public databases is reproduced under applicable Creative Commons or open data licenses. WA Mining Index claims no copyright over raw government data. Our proprietary value applies strictly to our independent data curation, taxonomy structure, design, and editorial content.

4. Verified Listings, Routed Enquiries and Editorial Independence

Certain features of the Platform operate on a commercial basis:

• Verified Listings: Suppliers and service providers may pay for a Verified Listing — placement on the service × region hub pages they cover (capped at three providers per page), a verified company profile with a "Verified" badge, a Verified entry in the supplier directory, and routed enquiries. All paid placements are clearly labelled as "Verified" (paid placement) or an equivalent disclosure. The commercial terms of a Verified Listing are set out in the Verified Listing Terms.
• Routed enquiries: Enquiries submitted through contact forms are forwarded to the relevant provider so they can respond to you directly. Routed enquiries are a feature of the paid Verified Listing, included as part of a flat subscription — we do not charge per lead, take a commission on resulting work, or resell enquiry data.
• Affiliate or commission arrangements: WA Mining Index does not currently operate affiliate or referral-fee arrangements with third parties. If we introduce one, we will disclose it on the page where the recommendation appears, in accordance with the Australian Consumer Law and Australian Competition and Consumer Commission (ACCC) guidance.

We maintain editorial independence over the organic structure and factual content of the Platform. Paid placements do not alter factual information about mining operations or the underlying directory data.

5. Intellectual Property

The curated structure, taxonomy logic, editorial content, design elements, and original written materials on WA Mining Index are the exclusive property of WA Mining Index.

You are prohibited from using automated scripts, spiders, web crawlers, or other programmatic methods to extract, copy, scrape, or mirror substantial portions of the Platform's content without our prior written consent. Unauthorized automated extraction of our curated directory may result in IP-level access bans and legal action.

Non-Compete and Reverse Engineering: You agree not to use the Platform or its curated taxonomy to build a directly competitive directory product. You may not reverse engineer, decompile, or attempt to extract the underlying source code or proprietary logic of the Platform.

User Feedback: If you provide us with suggestions, corrections, or feedback regarding the Platform or its data, you grant WA Mining Index a worldwide, perpetual, irrevocable, royalty-free license to use, incorporate, and distribute such feedback without obligation or compensation to you.

6. Listing Requests, Corrections and Removal

If you are an authorized representative of a business or operation listed on the Platform, you may request to: correct factual information about your business; request removal of your business listing; or enquire about Verified Listing options.

Requests can be submitted via our automated portal at waminingindex.com.au/opt-out or via the Contact page. We will action verified requests within a reasonable timeframe (generally 5 business days).

7. Limitation of Liability

WA Mining Index acts strictly as an informational aggregator and directory. We make no representations regarding the financial health, operational viability, safety record, regulatory standing, or creditworthiness of any mining operation or service company referenced on the Platform.

To the maximum extent permitted by applicable law, WA Mining Index shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from the use of, or inability to use, the Platform. This includes but is not limited to: misdirected freight or logistics arising from reliance on Platform data; failed contractor bids or commercial negotiations; operational downtime; any commercial dispute between users of the Platform and third parties listed on the Platform.

Cap on Liability: To the maximum extent permitted by applicable law, in no event shall WA Mining Index's total cumulative liability to you for any and all claims arising out of or relating to the use of the Platform exceed the greater of (a) AUD $100, or (b) the total amount paid by you to WA Mining Index in the twelve (12) months immediately preceding the event giving rise to the liability.

Nothing in these Terms excludes, restricts, or modifies any right or remedy you may have under the Australian Consumer Law (ACL) that cannot lawfully be excluded.

8. Third-Party Links

The Platform contains links to external mining company websites, government portals, contractor pages, and other third-party resources. We do not control and are not responsible for the content, privacy policies, accuracy, or business practices of any third-party site.

9. Paid Services (Where Offered)

Verified Listings are governed by the Verified Listing Terms, which a supplier accepts at checkout or by paying its invoice, and which prevail over this section to the extent of any inconsistency. In summary, and for any other paid service we may offer:

• Billing: Paid services are billed in advance via the payment processor identified at checkout or on the invoice. By providing payment information, you authorize us to charge your selected payment method according to the agreed terms.
• Taxes: Fees are stated exclusive of GST. Where WA Mining Index is registered for GST at the time of invoicing, GST is added to the invoice at the applicable rate; where it is not, no GST is charged and the invoice says so.
• Cancellation: A Verified Listing runs for the term stated in your Order Confirmation (monthly or annual) and renews automatically unless either party gives 30 days' written notice, as set out in the Verified Listing Terms. Pre-paid amounts for the current billing period are non-refundable unless required by law.
• Refunds: Subject to your rights under the Australian Consumer Law, refund policies for specific paid services will be communicated at the point of purchase.
• Lead Quality: Where enquiries are routed to a provider with a Verified Listing, a "lead" is a genuine third-party enquiry submitted through the Platform's contact forms expressing interest in the relevant services. We do not guarantee that any lead will result in a commercial outcome.

Specific paid services may be subject to additional terms communicated at the point of purchase.

10. Acceptable Use

You agree not to:

• Use the Platform for any unlawful purpose.
• Use the Platform or information obtained from it to send unsolicited commercial electronic messages in violation of the Australian Spam Act 2003 or equivalent legislation.
• Attempt to gain unauthorized access to any part of the Platform, its servers, or its underlying systems.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the Platform's operation, servers, or networks.

11. Modifications to the Platform and These Terms

We reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice. We also reserve the right to update these Terms at any time.

We will notify users of material changes by posting a notice on the Platform or, where applicable, by email. Continued use of the Platform after modifications constitutes acceptance of the updated Terms. For paying suppliers, changes to the Verified Listing Terms take effect only for a renewal term and with at least 30 days' notice, as set out in those Terms.

12. General Provisions

• Governing Law: These Terms are governed by the laws of Western Australia, Australia.
• Dispute Resolution: Before commencing legal proceedings, you agree to attempt informal resolution by contacting us via the Contact page. We will respond within 30 days. If informal resolution is unsuccessful, disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
• Force Majeure: WA Mining Index shall not be liable for any failure or delay in performance arising from conditions beyond our reasonable control, including natural disasters, government actions, cyberattacks, systemic internet failures, or third-party service provider downtime.
• Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
• Assignment: You may not assign or transfer these Terms without our prior written consent. WA Mining Index may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, or sale of substantially all of its assets.
• Entire Agreement: These Terms, together with our Privacy Policy, our Cookie Policy and — for paying suppliers — the Verified Listing Terms, constitute the entire agreement between you and WA Mining Index regarding your use of the Platform.
